IF YOU WERE ENROLLED IN A SCHOOL IN THE POMONA UNIFIED SCHOOL DISTRICT STARTING IN AUGUST 1, 2013, YOU MAY BE ELIGIBLE FOR A PAYMENT FROM A CLASS ACTION SETTLEMENT.

The Litigation is related to civil rights allegations that PUSD violated the Americans with Disabilities Act, Section 504 of the Rehabilitation Act of 1973, the Unruh Civil Rights Act as well as other claims, and that students with developmental disabilities suffered injury as a result. PUSD and the other defendants deny any wrongdoing and, neither this Notice nor the Settlement, is a determination or admission that any of the defendants did anything wrong.

YOUR LEGAL RIGHTS AND OPTIONS

Submit a Claim

You must submit a timely and valid claim in order to be eligible to receive a payment by: December 12, 2018.

Exclude Yourself

If you want to retain the ability to file your own lawsuit pursuing the claims sought in this Litigation by: December 12, 2018.

Object

You will be required to write to the Court, making your objection by December 12, 2018.

Go to the Fairness Hearing

The Court will consider the Settlement, the request for attorneys’ fees and expenses, and the Plaintiff’s request for an incentive award for pursuing the Litigation on March 18, 2019.

Do Nothing

You will not receive a payment from the Settlement Fund, you will give up your right to bring your own lawsuit, and to object to the Settlement.
